CONTEXT 188 : JUNE 2026 27 INFRASTRUCTURE will be recorded on a publicly available register. The trust will submit an annual summary report to Historic England, and publish the report and the works register on its website. Although the process is currently under review, the draft order at present requires that the secretary of state for the MHCLG must from time to time carry out a review of the order and publish a report setting out the conclusions of the review; the first report must be published within three years of the date of commencement of the order; and subsequent reports must be published at five-year intervals. These reports would assess whether the order had achieved its objectives and whether it remained appropriate to the desirability of preserving the special architectural or historic interest of the listed structures to which the order applied. The trust’s draft NLBCO and supporting documentation are nearing completion.The frustration is that despite all the work and partnership (between the trust, Historic England and the MHCLG), the final order must be laid before and approved by resolution of both Houses of Parliament before it can be signed into law by the secretary of state. It is not clear when this will happen, despite the ongoing deregulation of aspects of the UK planning process. It has been almost 14 years since the trust commenced work on its bespoke pilot NLBCO for England. When it is finally granted, it will break new ground for heritage management and will be a significant endorsement of the trust’s record for conserving a profoundly important network of historic waterways that powered the industrial revolution.
